We do not guarantee any specific results or outcomes from participating in our programs or using our Services. Individual experiences and results may vary.

3. Eligibility

To use our Services, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our Services under applicable law
• Provide accurate and complete information when registering or booking

By using our Services, you represent and warrant that you meet these eligibility requirements.

4. User Accounts

4.1 Account Creation

Some features of our Services may require you to create an account. When creating an account, you agree to:

• Notify us immediately of any unauthorized use of your account

5. Booking and Payment

5.1 Booking Process

When you book a session or program, you agree to:

• Provide accurate booking information
• Pay the applicable fees at the time of booking
• Attend scheduled sessions at the agreed time
• Comply with our policies and guidelines

5.2 Pricing and Fees

All prices are listed in Euros (EUR) and include applicable VAT unless otherwise stated. We reserve the right to change our prices at any time, but price changes will not affect bookings already confirmed.

5.3 Payment Methods

We accept payment via:

• Credit and debit cards (Visa, Mastercard, American Express)
• PayPal
• Bank transfer (for certain programs)

Payment processing is handled by third-party payment processors. We do not store your full payment card details.

5.4 Payment Terms

• Payment is due at the time of booking unless otherwise agreed
• For multi-session programs, payment plans may be available
• Failure to pay may result in cancellation of your booking
• All payments are subject to our Refund Policy

6. Cancellation and Rescheduling

6.1 Cancellation by You

You may cancel or reschedule your booking subject to the following terms:

• Discovery Sessions: Cancel or reschedule up to 24 hours before the scheduled time for a full refund
• Multi-session Programs: 7-day cooling-off period from the date of purchase
• 30-Day Challenge: Cancel within 7 days of purchase if the challenge has not yet started

6.2 Cancellation by Us

We reserve the right to cancel or reschedule sessions in the following circumstances:

• Instructor illness or emergency
• Insufficient enrollment for group programs
• Technical issues preventing service delivery
• Force majeure events

If we cancel a session, you will receive a full refund or the option to reschedule at no additional cost.

6.3 No-Show Policy

If you fail to attend a scheduled session without prior notice, you will not be entitled to a refund or rescheduling. We may, at our discretion, offer a one-time exception for extenuating circumstances.

7. User Conduct

When using our Services, you agree not to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Transmit any harmful, offensive, or inappropriate content
• Harass, abuse, or harm other users or our staff
• Impersonate any person or entity
• Interfere with or disrupt our Services or servers
• Attempt to gain unauthorized access to our systems
• Use our Services for any commercial purpose without our consent
• Collect or harvest information about other users
• Use automated systems (bots, scrapers) to access our Services

We reserve the right to suspend or terminate your access to our Services if you violate these conduct rules.

If you submit any content to us (e.g., feedback, testimonials, questions), you grant us a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and display such content for our business purposes.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that our Services will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of any content

• Personal injury or emotional distress
• Loss of goodwill or reputation

ARISING OUT OF OR RELATED TO:

• Your use of or inability to use our Services
• Any content or materials obtained through our Services
• Unauthorized access to or alteration of your data
• Any other matter relating to our Services

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Earthbeauty, its directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of our Services
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations

12. Termination

12.1 Termination by You

You may stop using our Services at any time. If you have an account, you may request account deletion by contacting us.

12.2 Termination by Us

We reserve the right to suspend or terminate your access to our Services at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Abusive or inappropriate behavior
• Non-payment of fees
• Prolonged inactivity

12.3 Effect of Termination

Upon termination:

• We may delete your account and data
• You will remain liable for any outstanding fees
• Provisions that by their nature should survive termination will continue to apply

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

14. Dispute Resolution

If you have a dispute with us, please contact us first to attempt to resolve the matter informally. We will make reasonable efforts to resolve disputes amicably.

14.2 Jurisdiction

Any disputes arising out of or related to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts of Amsterdam, Netherlands.

By mutual agreement, disputes may be resolved through binding arbitration in accordance with the rules of the Netherlands Arbitration Institute (NAI).

14.4 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
